Child custody in Texas distinguishes between several arrangements of custody and visitation. Unless you and your spouse can mutually agree upon a child custody and visitation schedule, the family court will order an arrangement according to state guidelines. Texas child custody law recognizes various parenting plans and shared custody arrangements, including legal custody, physical custody and visitation, and each will have different implications for child support depending on each spouse's income and resources.

Child Support

Texas law follows strict guidelines for the payment of child support through the age of 18. The Texas child support guidelines have fixed support amounts based on the number of children involved, up to 40% of the paying parent's financial resources. These guidelines consider, amongst other factors, the age of the child, the paying parent's income and ability to contribute to the child's support, any alimony or spousal maintenance being paid, the amount of time the paying parent has possession of or access to the child, as well as any special needs or requirements of the child. While the parties may enter into an amicable agreement concerning child support as a part of their custody arrangement, the court may still order the parties to alter their agreement or issue a child support order that is in the best interests of the child.
